Chandler sgt. hires lawyer, considers suing Arpaio

August 21st, 2008, 5:02 pm by Nick R. Martin

Sgt. Tom LovejoyChandler police Sgt. Tom Lovejoy, acquitted last week of animal cruelty in the death of his police dog, has hired a high-powered Phoenix attorney to consider suing the Maricopa County Sheriff’s Office because of his arrest.

Lovejoy (pictured left) confirmed late Wednesday he recently hired Michael Manning, an attorney with a history of filing — and often winning — high-profile lawsuits against the sheriff’s office and other agencies. Manning is currently representing two executives of the Phoenix New Times newspaper in a wrongful arrest lawsuit against the sheriff and county attorney. He is also representing the family of Carol Gotbaum, a woman who died in Phoenix police custody at Sky Harbor International Airport last year.

Manning could not be reached for comment Thursday, but his retention by Lovejoy signals that the Chandler sergeant is serious about the possibility of suing the county for his arrest and prosecution. In an exclusive interview earlier this week, Lovejoy said he still believes he was arrested to draw international media attention to Sheriff Joe Arpaio. The sheriff and his spokesmen have strongly denied the allegation.

UPDATE (5:02 p.m.): In a phone call this afternoon, Mike Manning said he and Lovejoy have not yet decided whether to bring a suit. There are a lot of elements at play that his firm must look at before he recommends anything to the sergeant, he said.

“Certainly what happened to him is inconsistent with the way the sheriff’s department has handled other similar deaths of dogs in their care,” Manning said. “It’s pretty clear that Sheriff Arpaio was treating this as an opportunity for press splash.”

Smoke fills Chandler school’s multipurpose room

August 13th, 2008, 10:58 am by Devon Hersom

Close to 2,000 students at two Kyrene district schools were evacuated Wednesday morning when smoke filled a multipurpose room of one of the schools, fire officials say.

According to Dan Couch of Chandler Fire, the multipurpose room of Kyrene de las Brisas Elementary School, located at Ray Road and Desert Breeze Boulevard, was filled with smoke and fire officials ordered an evacuation. Brisas’ joint school, Aprende Middle School, was also evacuated.

School officials originally believed that a ballast, which provides the power for florescent lighting, malfunctioned and caused the smoke.  After checking further, school officials discovered that smoke actually was coming from an air handler unit in the air conditioning system.

Classes for the two Kyrene schools started on Aug. 4.

Police: Elderly woman robbed of $3,200 in Chandler

August 1st, 2008, 3:45 pm by Devon Hersom

A 64-year-old woman was robbed Wednesday of $2,100 cash and $1,100 of jewelry after two men said they wanted to help her fix her vehicle, police say.

The two suspects flagged down the woman’s car at Chandler Boulevard and 56th Street at 2 p.m. and told her that smoke was coming out of her trunk, according to a release from the Maricopa County Sheriff’s office.

After the woman stopped, the men said they put out the trunk fire and offered to help her fix the problem for $2,100, MCSO said.

The men claimed to be mechanics and convinced the woman to drive to a nearby bank in the suspect’s tan SUV to withdraw the money from her account.

Once the woman withdrew the funds, the suspects drove her to her home in Sun Lakes. One of the men faked a diabetic coma, allowing the other to pocket $1,100 worth of jewelry in the home and also take the $2,100 in cash, the release said.

MCSO officers are looking for the suspects and say one in his 20s and the other is between 40 and 60 years old. They were last seen driving a tan GMC or Chevy Tahoe SUV. The younger man was around 5′7″ wearing a light blue shirt and the other man was around 5′10″ wearing a dark shirt and both were wearing blue jeans.

The sheriff’s office is asking that anyone with information regarding this case should call (602) 876-1011.

Driver takes out telephone pole, flees from scene

July 23rd, 2008, 4:32 pm by Devon Hersom

A 39-year-old truck driver was cited for hit and run Wednesday after he attempted to pull a U-turn on a private driveway and tangled his company truck in telephone wires, shattering the telephone pole, police said.

Chandler police spokesman David Ramer said the man, Antonio Pena, stopped at a Circle K gas station near the intersection of Fairview Street and Arizona Avenue to get a drink at 11:45 a.m.

Pena decided to pull a U-turn out of the gas station by using a driveway nearby.

He started to drive away, unaware that the top of his company truck had caught onto telephone wires and were stretching them, Ramer said.

The force of the pulling shattered one of the poles and cut power to a few homes in the area, Ramer said.

Pena fled the scene following the accident but a bystander wrote down his license plate number and gave it to Chandler police.

Pena was later found and cited with a hit and run, Ramer said.

Two Chandler cops accidentally shoot guns

July 21st, 2008, 4:47 pm by Katie McDevitt

Chandler police officials have launched an internal affairs investigation after two officers accidentally discharged guns on Friday —— once before and once after —— a Special Assignment Unit was called out to a crime.

Chandler police spokesman detective Frank Mendoza said no one was injured in the accidental shootings.

He refused to go into detail about how the shots were fired and said the case is currently under investigation internally.

Mendoza said accidental shootings by police are “very rare” because officers train extensively in the use of firearms.

Additional information wasn’t released by police.
