The brother of a man wanted for killing an armored guard in a brazen 2004 robbery outside an Ahwatukee Foothills theater was sentenced Monday to three years probation for giving false information to authorities investigating the case.
David J. Brown was was originally charged with obstruction of justice for tampering with a car belonging to his brother, Derek Brown, but he has since cooperated with authorities in attempting to find the fugitive, court records show.
Derek Brown, is wanted for the Nov. 29, 2004, robbery and shooting death of Robert Palomares.

The other is described as Hispanic, 17 to 20 years old, 5 feet 7 inches to 5 feet 8 inches, 160 to 165 pounds with short dark hair and a black T-shirt. They were last seen driving a gray or silver four-door Ford Focus with tinted windows. The incident occurred at the intersection of Southern Avenue and Extension Road about 10 p.m. When the woman driving the car was told to get out, she tried to grab her children and the carjackers fled the scene. They were last seen traveling south on Extension Road. Police say Garza was burglarizing the Mesa home of Michael Six, who hid in his room and called 911. Garza broke into the room and Six fought him off with the bat. When the suspects drove away in the van, police made a traffic stop on the men. The suspects bailed out of the car and ran off into a neighborhood, but were soon captured, police said. The cops found about 150 marijuana and two handguns in the van, and after a search warrant was served at a business where the U-Haul truck was parked, the rest of the marijuana was located and so was a rifle. The street value of the drugs is estimated at $1 million. |
